NY mayor seeks more disaster aid for Sandy victims

WASHINGTON (AP) ? New York City Mayor Michael Bloomberg appealed to congressional leaders Wednesday for quick action on providing tens of billions of dollars in new federal aid to help his city and state and others recover from Superstorm Sandy but was told it might be some time before it's forthcoming ? and it likely won't be all at once.

Bloomberg met with more than a half-dozen lawmakers, including several who chair or sit on committees controlling the government's purse strings, as well and both parties' leaders in the House and Senate.

"Hurricane recovery is not a partisan issue," he told reporters at a news conference in between the meetings. "We have to bring together both sides in Washington."

New York state alone is seeking $42 billion in additional federal aid. New Jersey is seeking federal aid to cover most of the nearly $37 billion cost for recovery and rebuilding.

So far about $2 billion in federal funds ? about half for direct assistance to individuals ? have been provided to the two most heavily damaged states and nine others in the storm's path. There's about $5 billion left in the Federal Emergency Management Agency's disaster relief fund, but last year's budget agreement permits President Barack Obama to seek another $5.4 billion without hitting a ceiling on spending.

Sen. Susan Collins of Maine, a member of the Appropriations Committee and the top Republican on the Homeland Security Committee that oversees disaster relief, struck a skeptical note after her meeting with the mayor.

"It's going to be a hard sell," she said, given Congress's preoccupation with the fiscal cliff crisis and tight budget restraints. Reflecting a line taken in the past by House Budget Committee Chairman Paul Ryan and other fiscal conservatives, she said at least some of the new spending for Sandy relief and rebuilding should be offset by spending cuts in other government programs.

"Otherwise it's just going to be added to the debt and that makes it even more difficult for us to deal with the fiscal challenges," she said.

Collins said she needs to see more detailed numbers on damages before deciding on how much Sandy aid is needed. But she said New York's request is "reasonable" if the damages can be documented and added that state and city officials have not tried to exaggerate the damages, as she claims happened with Hurricane Katrina seven years ago.

Bloomberg and New York Sen. Chuck Schumer said they were pressing White House officials for as much money as possible, as soon as possible, but they didn't know what amount Obama will seek. Whatever it is, the request could get tied up in the talks aimed at averting the fiscal cliff ? a $6 trillion combination of automatic tax increases and spending cuts ? beginning in January.

"There's no doubt this is going to be a hard fight," said Schumer. "We have a Congress that is decidedly less friendly to disaster aid than any in 100 years. We're in very strenuous negotiations over the fiscal cliff. We know money is short in Washington, just as it is in New York."

Schumer said he expects the fight for Sandy money to drag on for months and that several emergency spending bills will be needed. State officials worry that Congress's desire to satisfy the hunger for aid will fade as time wears on.

"So far we believe our colleagues have been very receptive," said Schumer. "But there's a long road to go and there are going to be many pitfalls in the way, particularly given the climate in Washington and the shortage in money."

New Jersey Gov. Chris Christie said Wednesday that it's up to New Jersey's congressional delegation ? made up of an equal number of Republicans and Democrats ? to fight for the $37 billion in additional aid that he's seeking. He said he and New York Gov. Andrew Cuomo have agreed not to compete with one another for federal funds.

"We're not going to allow any political forces in Washington, D.C., to divide and conquer us," Christie said. "We going to go down there as a team, we're going to work together and advocate for the numbers we put forward."

States other than New York and New Jersey now getting federal aid for Sandy are West Virginia, Virginia, Maryland, New Hampshire, Delaware, Rhode Island, Connecticut, Pennsylvania and Massachusetts, as well as the District of Columbia.

Foreclosure tidal wave fails to materialize in U.S., proving ...

Stockton, California, has the highest U.S. foreclosure rate. It also has a housing shortage.

The number of homes for sale in the city fell 42% in October from a year earlier. Listings routinely attract multiple offers. Prices are on the rise.

When banks pulled back on foreclosures two years ago following a government investigation into allegations of faulty practices, market researchers, academics and Wall Street analysts said that a surge of delinquent homes would deluge the U.S. market once lenders resolved the claims and worked through backlog, driving down prices for years to come. RealtyTrac Inc., a seller of property data, warned a year ago of a ?new set of incoming foreclosure waves.? Susan Wachter, professor at the University of Pennsylvania?s Wharton School, said in February that a logjam may be ?unleashed? and destabilize the market.

In fact, the flood failed to materialize, even after the five biggest U.S. mortgage servicers reached a US$25-billion settlement with federal and state regulators in February. Instead, the number of properties for sale shrank to the fewest in a decade, prices appreciated at the fastest pace since 2005, and the gradual healing of the housing market helped boost consumer confidence and the economy.

?We don?t have enough homes now to meet the needs of the market,? Paul Jacobson, a Stockton native and real estate broker for 22 years, said as he cruised the city?s northern fringe, where suburbia meets farmland. ?People see a foreclosed home for sale in this area and they?re going to jump on it.?

Bank Deals

Banks have stepped up foreclosure alternatives to avoid legal challenges. They?re forgiving debt, modifying payment plans and approving short sales that allow homeowners to sell for less than they owe.

The federal government, criticized by consumer activists for failing to prevent more than 4.7 million homes from being lost to foreclosure or short sales since President Barack Obama took office in January 2009, is also helping to stem the crisis. Expanded loan-modification programs have gained traction, and the Federal Reserve has kept bank interest rates near zero. Investors including Blackstone Group LP and Colony Capital LLC are purchasing thousands of foreclosed homes in bulk before they even hit the market, further limiting new supply.

With the unemployment rate also coming down, concerns are fading that a deluge in foreclosures will destabilize the housing market as it recovers from a six-year slump.

?Wrong?

?Many of us, myself included, feared a wave of foreclosures when the settlement came,? Wachter, professor of real estate and finance at Wharton in Philadelphia, said in a telephone interview. ?I was wrong.?

Slowing the foreclosure process has allowed banks to avoid booking losses on non-performing loans, said Joshua Rosner, an analyst with Graham Fisher & Co. in New York. U.S. banks reduced their net charge-off rate on mortgages to 0.77% in the second quarter, the most recent available, from a high of 1.81% at the end of 2009, according to data Rosner compiled. That drop occurred as the rate of non-current loans declined to 9.77% from 10.15% in late 2009.

?The goal all along ? from the banks, the servicers and the government ? was sort of to slow walk the whole thing, bleed it through over time,? Rosner said in a telephone interview.

Prices Rise

The strategy may be paying off. Home prices in 20 U.S. cities rose 3% in September from a year earlier, the most since 2010, the S&P/Case-Shiller index showed this week.

An index of pending home resales climbed 5.2% in October, exceeding the highest estimate in a Bloomberg survey of economists, figures from the National Association of Realtors showed Thursday in Washington. The median price of an existing home sold last month jumped 11% from a year earlier to US$178,600, the steepest annual increase since November 2005, according to the group. The number of previously owned homes on the market in October fell 1.4% to 2.14 million, the fewest since December 2002.

The Federal Reserve Bank of New York estimated that as many as 1.8 million properties would be taken back by banks in 2012, according to a January speech by President William Dudley. Through October, there have been about 559,000 home seizures, indicating a pace of about 650,000 for the year, according to Daren Blomquist, vice president of RealtyTrac.

The so-called shadow inventory of pending foreclosures, which may be larger than the visible supply of previously owned homes for sale, is shrinking as new defaults decline and banks work through their backlog of bad loans. Home loans that were more than 90 days late or in the foreclosure process, a proxy for the shadow inventory, fell to 7.03% of properties with a mortgage in the third quarter, the lowest share since 2008, the Mortgage Bankers Association said two weeks ago.

Managed Process

While lenders may bring more distressed properties to market over the next year, it won?t be enough to depress values, said Vishwanath Tirupattur, housing strategist at Morgan Stanley in New York.

?I don?t anticipate a flood that will take the market down with it,? he said in a telephone interview. ?It will be a much more managed process.?

The shadow inventory ? which also includes properties owned by banks but not for sale ? fell from an estimated 8.8 million homes in 2010 to 5.36 million as of this month, a faster decline than expected as fewer loan modifications re-defaulted, according to Tirupattur.

Changes to Obama?s loan-modification program had the biggest impact on reducing pending foreclosures since late 2010 by creating a template that lenders followed, Wachter said. That included incentives to compensate loan servicers for reducing principal on loans for delinquent borrowers. In January, the administration tripled the award to 63 cents for every $1 in writedowns.

?Transformative Steps?

?The loan modifications were successful in this new wave,? she said. ?Transformative steps were being put into place in the loan modification process. I underestimated how transformative those reforms would be.?

An estimated 1 million homeowners qualify for payment-plan changes with principal reductions under Obama?s guidelines, according to Wachter. Assuming a redefault rate of 25%, that would result in almost 750,000 sustainable modifications, Wachter wrote with Mark Zandi, Celia Chen and Cristian deRitis of Moody?s Analytics Inc. in a report published in May.

?Along with those that would take place in any event, this is about the number needed to forestall any further house-price declines,? they said.

Principal Forgiveness

Since the February settlement, the five largest U.S. mortgage servicers provided loan relief to 309,385 borrowers, including trial plans, according to a Nov. 19 report by Joseph Smith, monitor of the deal. Almost 22,000 borrowers had principal forgiveness totaling US$2.55-billion. The companies, which include Bank of America Corp. and JPMorgan Chase & Co., agreed to short sales for 113,000 borrowers for another US$13.1-billion in principal write downs, Smith?s report said.

The settlement helped stabilize prices, in part, by encouraging alternatives to foreclosures, including principal forgiveness and short sales, said Nela Richardson, senior economic analyst with Bloomberg Government. Modified loans have a high default rate and may eventually show up as foreclosures or short sales, she said.

?In this sense, I think the shadow inventory is still looming but it does not look like it will come out of the shadows all at once,? Richardson said in an e-mail. ?Rather, properties will trickle out into the market.?

About 940,000 modifications will be completed this year, including 100,000 resulting from the US$25-billion mortgage settlement, according to a Nov. 21 report by JPMorgan analysts led by John Sim. The pace will fall next year to about 530,000 as the pool of eligible borrowers shrinks.

Short Sales

Short sales made up 9.3% of transactions in September, up from 7.8% a year earlier and 5.8% in September 2009, according to CoreLogic Inc., an Irvine, California-based real estate data firm.

?The best, lasting legacy of the crisis is that the industry has created a more nuanced approach to loss disposition,? said Mark Fleming, chief economist of CoreLogic. ?I don?t think the idea of evaluating a delinquent borrower for all different alternatives goes away after we?ve dealt with the shadow inventory. I think that?s here to stay.?

In Stockton, about 80 miles (129 kilometers) east of San Francisco by car, the foreclosure crisis is easing after a plunge in home values that has left prices down 60% from a 2006 peak. The city earlier this year became the largest in the U.S. to file for bankruptcy protection from creditors after the collapse of the housing market left it with mounting retiree health-care costs for employees and an eroding tax base amid accounting errors that overstated municipal revenues.

Highest Rate

One in 67 of Stockton?s households received a foreclosure filing in the third quarter, the highest rate of any U.S. metropolitan area with a population of more than 200,000, according to RealtyTrac. The number of filings of default, auction or repossession fell 21% from a year earlier.

William Hoeurn, a teacher?s assistant in Stockton, last month won a US$337,906 principal reduction on his mortgage from Bank of America, reducing monthly payments on his three-bedroom house to US$884 from US$2,362. Hoeurn fell behind on his loan payments after his wife lost her job and two of his grown children, who helped pay the mortgage, moved out of the home.

?Before, I was having bad dreams that I am losing my house,? Hoeurn, 66, a refugee from Cambodia, said during an interview in his kitchen. ?Now, I feel very happy.?

Short Sales

The number of bank-owned homes listed for sale in Stockton plunged 72% in September from a year earlier, according to MetroList Services Inc., a Sacramento, California-based listing information service. Short sale listings fell 63% to 155 homes.

Re-sale prices rose 14.6% in the 12 months through October to US$179,570 in San Joaquin County, where Stockton is the county seat, according to the California Association of Realtors.

Peter Lemos, code enforcement field manager for Stockton?s police department, said he suspects banks are delaying foreclosures to reduce the supply of houses on sale and keep prices higher.

?If they flooded the market, prices would go down,? Lemos said during an interview in his office. ?So they?re getting more for what they?re selling. At the same time, it?s making more work for us.?

Painting Lawns

There were 6,650 properties with unresolved code violations as of Sept. 30, about two-thirds of which were vacant because the owners walked away and banks hadn?t foreclosed, Lemos said. His team stages night raids to oust squatters from abandoned properties. To give the appearance homes are occupied, they paint dry lawns green.

Rick Simon, a spokesman for Bank of America, and Tom Kelly, a spokesman for JPMorgan, said they aren?t keeping foreclosed properties off the market to boost prices or avoid booking losses.

?Under servicing agreements and investor guidelines, we generally are compelled to move defaulted loans through the foreclosure process and bring them to market without undue delays in order to curtail servicing costs and recover as much of the investment for the owner of the loan as possible,? Simon said in an e-mail.

Potential Foreclosures

The inventory of potential foreclosures remains a threat across the U.S. and could result in a new wave of defaults and depress home values, especially if the economy slows, said Robert Shiller, an economics professor at Yale University. Homeowners who owe more than their properties are worth are more likely to default if they lose a job, need to move for employment, or simply decide to walk away, he said.

?I?m still worried about home price declines,? Shiller, and co-creator of the S&P/Case-Shiller home-price indexes, said in a telephone interview. ?It?s funny how people have so much confidence in the recovery. History shows that these markets are hard to predict.?

Delaying the process may also be hindering a faster recovery, said Anthony B. Sanders, an economics professor at George Mason University in Fairfax, Virginia.

?The best cure for any market meltdown is to let prices fall to whatever level is needed to clear it,? he said. ?Instead, we?re sitting here in 2012 and we?re still not out of the woods yet. The wisdom of delaying foreclosures etc. was more of a political act than an economic act.?

Bank Seizures

Mortgages on homes seized by banks averaged a record 708 days delinquent in September, up from 624 days a year earlier, according to Lender Processing Services Inc. The U.S. average was 367 days in December 2008, before Obama took office and launched an alphabet soup of programs to help struggling homeowners keep their residences.

Maybe bureaucracy is actually helping, in this case, to diffuse the impact of the foreclosures

The February mortgage settlement restricted lenders from so-called ?dual-tracking? ? simultaneously pursuing a foreclosure while borrowers were in the process of applying for a loan modification ? a limitation that prolongs the time it takes lenders to repossess a house.

?In hindsight, by delaying and prolonging the foreclosure process, that gave the market time to stabilize and get back on its feet,? said Blomquist of RealtyTrac. ?Maybe bureaucracy is actually helping, in this case, to diffuse the impact of the foreclosures. Talk about unintended consequences.?

Fed Prevents

Low interest rates engineered by the Federal Reserve prevented a wave of defaults that would have been triggered by resets for borrowers with adjustable-rate mortgages, said Karen Weaver, head of market strategy and research at Seer Capital Management LP in New York.

?With very low interest rates, that?s been completely finessed,? Weaver said in a telephone interview. ?That?s another reason we haven?t had the tsunami.?

An Obama program begun in February allowing refinancing for Americans with more than 125% negative equity also has reduced incentives for underwater homeowners to abandon their property. The higher threshold opens the door for about 5 million borrowers to refinance, according to CoreLogic.

More than 100,000 borrowers a month, most of whom have no equity in their homes, have been able to get lower interest rates through the Home Affordable Refinance Program.

?We were originally skeptical,? Paul Ashworth, chief U.S. economist for Capital Economics Ltd., wrote in a note sent last week. ?But we have to admit that it has made a significant difference.?

The foreclosure slowdown took place as the broader economy began to heal. The unemployment rate fell to 7.8% in September, the lowest since Obama took office.

Household Formations

Household formations increased to an annual pace of 1.15 million in the third quarter, driving down the vacancy rate for rental homes to its lowest rate since 2002, while the vacancy rate for owner-occupied properties dropped to 1.9%, a level last seen in 2005, according to the Census Bureau.

Homes that are seized by banks are attracting investors, many of which aim to turn them into rentals. Private-equity firms are raising as much as US$8-billion to buy single-family homes, often purchasing at auctions or directly from banks before the properties are publicly listed for sale. New York- based Blackstone, the world?s biggest private-equity firm. has been buying US$100-million of houses a week, Chairman Stephen Schwarzman said during an Oct. 18 earnings call.

For those foreclosed properties that do hit the market, investor purchases are rising. All-cash sales represented 29% of existing-home deals in October, according to the National Association of Realtors. Investors, who account for most cash sales, purchased 20% of homes in October, up from 18% the previous month and a year earlier.

Phoenix Demand

Some hot markets are seeing even more demand. In Arizona?s Maricopa County, home of Phoenix, investors accounted for a third of home purchases, including those at auctions, said Michael Orr, director of real estate research at Arizona State University?s W.P. Carey School of Business.

Investors and other homebuyers are moving east toward Stockton from the San Francisco Bay area, where the technology industry has kept property values high, said Jerry Abbott, president of Grupe Real Estate, a Stockton-based sales and development company that has acquired more than 1,000 rental homes since 2010.

?My guess is 50% of the active closings are investors,? Abbott said in a telephone interview. ?Everybody and his uncle wants to get in at low prices.?

Wave of bombings south of Baghdad kills 16

BAGHDAD (AP) ? Iraqi police and health officials say bombings in two cities south of Baghdad have killed at least 16 people and wounded over 65.

A police officer says back-to-back explosions on Thursday in a busy commercial area of the city of Hillah killed at least 10 people and wounded 45. He says the attacks started with a roadside bombing that was followed by a car bomb explosion when rescuers rushed to the scene.

Police and health officials say a car bomb blast at the gates of the southern city of Karbala killed six people and wounded 20 just hours earlier.

Both cities lie in Iraq's Shiite heartland in the country's south. All officials spoke on condition of anonymity because they are not authorized to talk to the media.

On the other hand, it can be an adventure if squads of local kids gather for a hockey game. It's groomed sometimes by the Milwaukee County Parks staff and regularly by neighborhood volunteers. When the park is staffed during daylight hours, the warm-up room in the basement of the pavilion offers bathrooms and benches for changing into and out of skates.

3 BP employees arraigned on Gulf oil spill charges

NEW ORLEANS (AP) ? Two BP rig supervisors and a former BP executive pleaded not guilty Wednesday to criminal charges stemming from the deadly Deepwater Horizon rig explosion and the company's response to the massive 2010 spill in the Gulf of Mexico.

BP well site leaders Robert Kaluza and Donald Vidrine, along with former BP vice president of exploration for the Gulf David Rainey, remained free on bond following their arraignments in federal court.

Kaluza and Vidrine are charged with manslaughter in the deaths of 11 rig workers. They are accused of disregarding abnormally high pressure readings that should have been glaring indications of trouble just before the blowout of BP's Macondo well.

Rainey was charged separately with concealing information from Congress about the amount of oil that was leaking from the well. Millions of gallons of crude oil spewed from BP's well for months.

Kaluza professed his innocence on his way into court, making his first public comments since the April 2010 explosion that killed his co-workers.

"I think about the tragedy of the Deepwater Horizon every day," Kaluza told reporters. "But I did not cause this tragedy. I am innocent and I put my trust, reputation and future in the hands of the judge and the jury."

Kaluza and Vidrine's lawyers both accused the Justice Department of using their clients as scapegoats. They noted that other government investigations have spread out the blame for the disaster and concluded it was the product of a complex series of mistakes, made both onshore and on the rig.

"Bob and Don did their jobs," said Shaun Clarke, one of Kaluza's attorneys. "They did them correctly and they did them in accordance with their training."

Robert Habans, one of Vidrine's lawyers, said his client diligently followed instructions he received from engineers and others onshore.

"He's not the architect or the engineer. He didn't design the well, and he didn't make the critical decisions in this case," Habans said.

The case against Kaluza and Vidrine centers on their roles in supervising "negative testing," which is designed to assess whether a cement barrier is effectively preventing oil or gas from flowing up the well. The indictment says they had "multiple indications" from the negative testing that the well wasn't secure. Yet they allegedly failed to alert onshore engineers about the problems during the testing, accepted a "nonsensical explanation" for abnormal pressure readings and eventually decided to stop investigating.

Habans, however, said court records related to civil litigation over the spill indicates Vidrine did discuss the test results with an onshore engineer less than an hour before the blast. A Justice Department attorney questioned a BP expert about the phone conversation between Vidrine and the engineer, Mark Hafle.

"It's almost inconceivable to me that the government in the indictment makes a contrary allegation," Habans said.

Lawyers for Rainey declined to comment.

A trial for Kaluza and Vidrine is scheduled to start on Feb. 4, while Rainey has a Jan. 28 trial date. Both dates could be postponed given the complexity of the cases.

BP announced earlier this month that it will plead guilty to manslaughter, obstruction of Congress and other charges and pay a record $4.5 billion in penalties to resolve a Justice Department probe of the disaster.

Attorneys for BP and the Justice Department are scheduled to meet Dec. 11 with a federal judge to discuss a date for the company to plead guilty.

The Deepwater Horizon oil rig, owned by Transocean Ltd. but operated on behalf of BP, was drilling in the Gulf of Mexico off the Louisiana coast on April 20, 2010, when it was rocked by an explosion. The bodies of 11 workers were never recovered.

Professor to speak on creative writing at Columbia | The Ithacan

Catherine Taylor, associate professor of writing, who began her writing career as a nonfiction writer, defies the separation of genres in creative writing with her latest book, ?Apart.? The anthropology department at Columbia University invited Taylor to give her lecture, titled ?Between Art and Politics: ?Ficto-Criticism? and Suspended Genres,? and a reading from ?Apart? on Thursday. Taylor?s newly released book discusses the politics of South Africa and her personal connection with the country.

Nicole Arocho: What?s your latest book about?

Catherine Taylor: It?s a quirky book mainly because it is a multi-genre book, although it?s more nonfiction than the other genres. The book shifts from essays, prose poems, photographs, archives and excerpts from archives. It?s all related to South African political history but also my family?s history in South Africa.

NA: How do you feel about being invited by the Columbia University Anthropology Department to give a lecture and a reading?

CT: It was exciting to get that kind of validation in a discipline that is not my own. Professor Michael Taussig [of Columbia] read the book and wrote me a paper letter, because he couldn?t find my email, which I will treasure forever.

NA: What was your writing process behind ?Apart?? How did it end up being a multi-genre book instead of just nonfiction?

CT: The book started as a very normal, standard memoir, but it became apparent to me very early on that that wasn?t going to work, because the topic was so complex, and I had a difficult time understanding it. It seemed to me that the book wanted to be as broken and fragmented as my understanding was. Otherwise it felt like a lie.

NA: How would you describe writing in collage mode?

CT: It was fun and liberating; it gave me the freedom of writing poems, essays, gathering pictures. Working this way let me use the archive material in a way that made sense to me. Using collage as my mode of writing gave me the opportunity of telling more stories rather than choosing a few and focusing on those only.

NA: Were there any authors that inspired you to write a cross-genre book?

CT: Yes, Michael Taussing is definitely one of them. He coined the term ?ficto-criticism,? which mixes fiction and criticism. Also the documentary poet Charles Reznikoff, with his book ?Testimony,? and Anne Carson, with her wildly lyrical essay poems. Susan Griffin is in there too. I?m going to teach her book ?A Course of Stones: The Private Life of War? next semester.

NA: How is this lecture different from any other lectures you?ve done so far?

CT: Well, this is the first time that I?ll be giving a lecture related to ?Apart? after the book was published, after I?d written the whole thing. Another thing that?s different is that I?m being invited to both read both as a creative artist and as a scholar.

NA: What would you recommend to students who want to be both writers and scholars like you?

CT: I would say, be patient. Some things you may want to do just take a really long time. It takes a long time to find yourself as a writer, to develop your craft, to find a place in the world and to find your community of writers. To those students who are torn between scholarly work and creative writing: You can be both.

NA: Are you already working on a new book?

CT: I am. I?m working on a project about military drones. What interests me is the complex place of the drone in human life by those who are being attacked by them. That?s what I want to explore.

Inside America's Tax Battle by Laura Tyson - Project Syndicate

BERKELEY ? America?s recent presidential election answered the question of whether an increase in revenues will be part of the country?s long-run deficit-reduction plan. The answer is yes: there is now bipartisan agreement on the need for a ?balanced? approach that includes revenue increases and spending cuts.

But there are still deep political and ideological divisions about how additional revenues should be raised and who should pay higher taxes. If a preliminary agreement on these questions is not reached by the end of the year, the economy faces a ?fiscal cliff? of $600 billion in automatic tax increases and spending cuts that will shave about 4% from GDP and trigger a recession.

The majority of citizens agree with President Barack Obama that tax increases for deficit reduction should fall on the top 2-3% of taxpayers, who have enjoyed the largest gains in income and wealth over the last 30 years. That is why he is proposing that the 2001 and 2003 rate cuts for these taxpayers be allowed to expire at the end of the year, while the rate cuts for other taxpayers are extended.

So far, Obama?s Republican opponents are adamant that the cuts be extended for all taxpayers, arguing that increases in top rates would discourage job creation. This claim is not supported by the evidence. Recent research finds no link between tax cuts for top taxpayers and job creation. In contrast, tax cuts for the bottom 95% have a positive and significant effect on job growth.

During the past three decades, income inequality in the United States has increased significantly; indeed, the US now has the fourth-highest level of income inequality in the OECD, behind Chile, Mexico, and Turkey. At the same time, as the largest tax cuts have gone to high-income taxpayers, the US tax system has become considerably less progressive. The US needs fiscal measures that both curb the deficit and contain rising income inequality ? and the inequality of opportunity that it begets.

But how should additional revenues be raised from top taxpayers to achieve these two goals? Most economists believe that increasing revenues by reforming the tax code and broadening the tax base is ?probably? better for the economy?s long-term growth than raising income-tax rates. The analytical case for this belief is strong, but the empirical evidence is weak.

In theory, higher marginal tax rates have well known negative effects ? they reduce private incentives to work, save, and invest. Yet most empirical studies conclude that, at least within the range of income-tax rates in the US during the last several decades, these effects are negligible.

A recent Congressional Research Service report, withdrawn under pressure from Congressional Republicans, found that changes in the top income-tax rate and the rate on capital gains had no discernible effect on economic growth during the last half-century. A recent review of the economic literature by three distinguished academics found no convincing evidence that real economic activity responds materially to tax-rate changes on top income earners, although such changes do affect their tax-avoidance behavior. So Obama has evidence on his side when he says that allowing the tax cuts for high-income taxpayers to expire at the end of the year will not affect economic growth.

Republicans have proposed tax reforms in lieu of rate hikes on high-income taxpayers to raise revenues for deficit reduction. Obama has signaled that he is willing to consider this approach, provided it increases tax revenues from the top 2-3% by at least the same amount as higher rates while protecting other taxpayers.

The federal tax system is certainly in need of reform. Tax expenditures ? which include all deductions, credits, and loopholes ? account for about 8% of GDP. Indeed, the US tax code is riddled with special preferences and contains large differences in effective tax rates across individuals and economic activities. These differences distort decisions about investment allocation and financing. Reforms that made the tax system simpler, fairer, and less distortionary would have a beneficial effect on economic growth, although economists concede that the size of this effect is uncertain and impossible to quantify.

Because tax expenditures are so large, limiting them could raise a significant amount of additional revenue that could be used both for deficit reduction and to finance across-the-board cuts in income-tax rates. Analysis of the Simpson-Bowles and Domenici-Rivlin deficit-reduction plans by the nonpartisan Tax Policy Center confirms that this approach is arithmetically feasible. Reducing large regressive tax expenditures like preferential tax rates for capital gains and dividends and deductions for state and local taxes, and replacing deductions with progressive tax credits, could generate enough revenue to finance rate cuts for all taxpayers, increase the tax code?s overall progressivity, and contribute meaningfully to deficit reduction.

But the odds of such an outcome are very low: what is arithmetically feasible is unlikely to be politically possible. Efforts to cap popular tax expenditures will encounter strong opposition from Republicans and Democrats alike. Nonetheless, some tax reforms are likely to be a key component of a bipartisan deficit-reduction deal, because they provide Republicans who oppose increases in tax rates for high-income taxpayers with an ideologically preferable way to increase revenue from them.

Unfortunately, it will take time to negotiate tax reforms ? more time than remains until the end of the year, when the 2001 and 2003 tax cuts are scheduled to expire for all taxpayers. But there is still time to negotiate an agreement that extends these cuts for the bottom 98%, and that contains temporary measures to cap deductions and credits for high-income taxpayers in 2013. Such an agreement could help to break the political impasse over whether and how much these taxpayers? rates should rise next year, thereby preventing the US from falling over the fiscal cliff and back into recession.

Manchester City striker Tevez banned for speeding

MORECAMBE, England (AP) -Manchester City striker Carlos Tevez has been banned from driving for speeding.

Magistrates in the northern English town of Lancaster imposed the interim ban on Monday after he failed to provide identification when he was caught speeding in nearby Morecambe on March 28.

The Argentina international did not attend the hearing.

His solicitor Gwyn Lewis told the court that "my instructions are though (Tevez) was not the driver on that occasion I am not going to argue against a ban on grounds of exceptional hardship."

Separately, Tevez's Porsche Panamera was impounded in Manchester on Nov. 15 because he could not produce a full British driving license.

Two days later, Tevez mimicked driving a car after he scored twice in his team's Premier League win against Aston Villa.

Hobbits, superheroes put magic in NZ film industry

WELLINGTON, New Zealand (AP) ? A crate full of sushi arrives. Workers wearing wetsuit shirts or in bare feet bustle past with slim laptops. With days to go, a buzzing intensity fills the once-dilapidated warehouses where Peter Jackson's visual-effects studio is rushing to finish the opening film in "The Hobbit" trilogy.

The fevered pace at the Weta Digital studio near Wellington will last nearly until the actors walk the red carpet Nov. 28 for the world premiere. But after "The Hobbit: An Unexpected Journey" hits theaters, there's more work to be done.

Weta Digital is the centerpiece of a filmmaking empire that Jackson and close collaborators have built in his New Zealand hometown, realizing his dream of bringing a slice of Hollywood to Wellington. It's a one-stop shop for making major movies ? not only his own, but other blockbusters like "Avatar" and "The Avengers" and hoped-for blockbusters like next year's "Man of Steel."

Along the way, Jackson has become revered here, even receiving a knighthood. His humble demeanor and crumpled appearance appeal to distinctly New Zealand values, yet his modesty belies his influence. He's also attracted criticism along the way.

The special-effects workforce of 150 on "The Lord of the Rings" trilogy a decade ago now numbers 1,100. Only five of Weta Digital's workers are actual employees, however, while the rest are contractors. Many accept the situation because movie work often comes irregularly but pays well. Union leaders, though, say the workers lack labor protections existing in almost any other industry.

Like many colleagues, Weta Digital's director, Joe Letteri, came to New Zealand in 2001 to work on the "Rings" trilogy for two years. The work kept coming, so he bought a house in Wellington and stayed.

"People come here because they know it's their chance to do something really great and to get it up on the screen," he said in a recent interview.

Jackson, who declined to be interviewed for this story, launched Weta in 1993 with fellow filmmakers Jamie Selkirk and Richard Taylor. Named after an oversized New Zealand insect, the company later was split into its digital arm and Weta Workshop, which makes props and costumes.

Loving homages to the craft are present in Weta Digital's seven buildings around the green-hilled suburb of Miramar. There are old-time movie posters, prop skulls of dinosaurs and apes, and a wall of latex face impressions of actors from Chris O'Donnell to Tom Cruise.

Its huge data center, with the computing power of 30,000 laptops, resembles a milk-processing plant because only the dairy industry in New Zealand knew how to build cooling systems on such a grand scale.

Little of Weta's current work was visible. Visitors must sign confidentiality agreements, and the working areas of the facilities are off-limits. The company is secretive about any unannounced projects, beyond saying Weta will be working solidly for the next two years, when the two later "Hobbit" films are scheduled to be released.

The workforce has changed from majority American to about 60 percent New Zealanders. The only skill that's needed, Letteri says, is the ability to use a computer as a tool.

Beyond having creativity as a filmmaker, Jackson has proved a savvy businessman, Letteri says.

"The film business in general is volatile, and visual effects has to be sitting right on the crest of that wave," Letteri says. "We don't get asked to do something that somebody has seen before."

The government calculates that feature films contribute $560 million each year to New Zealand's economy. Like many countries, New Zealand offers incentives and rebates to film companies and will contribute about $100 million toward the $500 million production costs of "The Hobbit" trilogy. Almost every big budget film goes through Jackson's companies.

"New Zealand has a good reputation for delivering films on time and under budget, and Jackson has been superb at that," says John Yeabsley, a senior fellow at New Zealand's Institute of Economic Research. "Nobody has the same record or the magic ability to bring home the bacon as Sir Peter."

"You cannot overestimate the fact that Peter is a brand," says Graeme Mason, chief executive of the New Zealand Film Commission. "He's built this incredible reputational position, which has a snowball effect."

Back in 2010, however, a labor dispute erupted before filming began on "The Hobbit." Unions said they would boycott the movie if the actors didn't get to collectively negotiate. Jackson and others warned that New Zealand could lose the films to Europe. Warner Bros. executives flew to New Zealand and held a high-stakes meeting with Prime Minister John Key, whose government changed labor laws overnight to clarify that movie workers were exempt from being treated as regular employees.

Helen Kelly, president of the New Zealand Council of Trade Unions, says a compromise could easily have been reached. She says the law changes amounted to unnecessary union-busting and a "gross breach" of employment laws.

"I was very disappointed at Peter Jackson for lobbying for that," she says, "and I was furious at the government for doing it."

Weta Digital's general manager Tom Greally compared it to the construction industry, where multiple contractors and mobile workers do specific projects and then move on.

Animal rights activists said last week they plan to picket the premiere of "The Hobbit" after wranglers alleged that three horses and up to two dozen other animals died in unsafe conditions at a farm where animals were boarded for the movies. Jackson's spokesman Matt Dravitzki acknowledged two horses died preventable deaths at the farm but said the production company worked quickly to improve animal housing and safety. He rejected claims any animals were mistreated or abused.

Jackson's team pointed out that 55 percent of animal images in "The Hobbit" were computer generated at Weta. The People for the Ethical Treatment of Animals (PETA) have asked Jackson in the future to create all his animals in the studio.

Controversies aside, the rise of Weta and the expat American community in and around Miramar is visible in everything from a Mexican restaurant to yoga classes. On Halloween, which in the past was not much celebrated in New Zealand, hundreds of costumed children roamed about collecting candy. Americans gave the tradition a boost here, but the locals have embraced it.

The National Business Review newspaper estimates Jackson's personal fortune to be about $400 million, which could rise considerably if "The Hobbit" franchise succeeds. Public records show Jackson has partial ownership stakes in 21 private companies, most connected with his film empire. He's spent some of his money on philanthropy, helping save a historic church and a performance theater.

For all his influence, Jackson maintains a hobbit-like existence himself, preferring a quiet home life outside of work. In the end, many say, he seems to be driven by what has interested him from the start: telling great stories on the big screen.

Bjork undergoes vocal cord surgery

Bjork is on the rebound. In a message posted on her website Wednesday, the Icelandic pop queen confirmed that she underwent successful surgery to remove a polyp from her vocal cords.

No word exactly when the procedure took place, but she appears to have opted for the surgery sometime this fall.

Bjork, 47, said she first discovered the polyp a few years ago and tried to rid herself of it by doing stretches and changing her diet, but after advances in technology to treat the condition, she finally decided to go under the knife.

"Surgery rocks!" she told fans. "I stayed quiet for 3 weeks and then started singing and definitely feel like my cords are as good as pre-nodule. It's been very satisfying to sing all the clear notes again."

The singer apologized for having had to cancel various commitments earlier this year, but she didn't want to release information about the operation until she knew it would work.

Egypt's Morsi insists he won't be another dictator

As Egypt's President Mohammed Morsi said he took the power of the courts to impose stability, protesters argued he is becoming a dictator. NBC's Jim Maceda reports.

Responding to violent protests over the last four days, Egypt's President Mohammed Morsi insisted that he assumed control of the judiciary to stabilize the country ? not to concentrate power.

Protesters say that Morsi, who became the country?s first democratically-elected president on June 30, issued a decree of near-total executive power to elevate himself to Pharaoh-like status. They also worry that Morsi and his supporters will draft a constitution that will put Egypt on track to becoming like religiously conservative Iran or Turkey.

Morsi?s supporters say his control of the courts is temporary ? a necessary move, they say, because the courts are governed by former President Hosni Mubarak appointees who have blocked the country's transition to democracy.


According to the BBC, a statement by the presidency emphasized that Morsi's measures were implemented to avoid ?attempts to undermine democratically elected bodies and preserve the impartiality of the judiciary."

Regardless of Morsi?s intent, the fallout has been acute. Six of his aides resigned Sunday, and stock markets plunged by 10 percent in Egypt. Youth protesters attacked the headquarters of the Muslim Brotherhood?s Freedom and Justice Party ? with which Morsi is affiliated ? killing one and wounding 60. Fights have even broken out between journalists covering the escalating tension.

The BBC?s Jon Leyne wrote that Morsi?s actions ? whether na?ve or over-confident ? could result in sectarian struggle. Morsi issued his decree on Thursday, the day after he was lauded by Secretary of State Hillary Clinton for helping to negotiate a truce between the Palestinians and Israel.

In Cairo?s Tahrir Square, NBC?s Jim Maceda reported that Egyptians are understandably nervous, given their political history. Mubarak maintained military rule for three decades before he was overthrown during the Arab Spring revolution in February 2011.

That sentiment was reflected in a statement by the liberal Constitution party, according to the Guardian: "We are facing a historic moment in which we either complete our revolution or we abandon it to become prey for a group that has put its narrow party interests above the national interest."

Morsi says he is committed to finding ?common ground? with other political parties, and he plans to meet with senior judges on Monday to work toward a compromise, the BBC reported. Meanwhile, both sides have called for mass protests in Cairo on Tuesday.

U.S. State Department spokeswoman Victoria Nuland weighed in on Friday, Al Jazeera reported, saying that Morsi?s declarations ?raise concerns for many Egyptians and for the international community.?

"One of the aspirations of the revolution was to ensure that power would not be overly concentrated in the hands of any one person or institution," Nuland said.
